Description

When Clinical Practice, Ethics, and Laws Collide—Oh My!

In today's litigious society, being a great mental health professional is not enough to avoid ethics complaints, licensing board sanctions, and even legal liability. If you work in the field of behavioral health care, you must also understand professional codes of ethics, licensing board regulations, and laws in the governing jurisdiction. It is necessary to understand how these intertwine with clinical practice and what to do when those worlds collide—because they will! Integrated training in these inseparable areas has been fragmented at best and sometimes all together absent. What should you do when best clinical practices conflict with codes of ethics? What about when your code of ethics conflicts with laws? How can you stay informed of changes in codes of ethics, licensing board regulations, and new laws?

This one-day seminar provides an integrative approach to understanding and resolving conflicts between the clinical, ethical, and legal aspects of mental health practice. Whereas many mental health trainers will refer you to a lawyer to address legal issues and lawyers will refer you to clinicians to address clinical issues, Dr. Stinson—as a psychologist and lawyer—gives you a two-for-one training experience, uniquely addressing the clinical and legal aspects together. A comprehensive model will be presented to guide attendees through some of the most common ethical-legal breaches committed by mental health professionals with concrete suggestions to avoid the pitfalls that are inevitable in practice. Learn how to decrease your risk of ethics and board complaints as well as legal liability and increase your competence and comfort in resolving clinical-ethical-legal dilemmas. In addition to being informative, this course is designed to be engaging and interactive!

AN INTEGRATIVE, DECISION-MAKING MODEL

  • How to balance the variables that go into making the “gray-area” judgment calls in your daily practice

 

ETHICS CODES, REGULATORY BOARDS, AND LAWS

  • What if there are conflicts between them?
  • Updates that affect your practice

 

CONFIDENTIALITY ISSUES

  • Who has the right to confidentiality?
  • What is the difference between confidentiality and privilege?
  • Who can waive the right to confidentiality?
  • Who can waive privilege?
  • What if the release of records is not in the best interest of the client?

 

SUBPOENAS

  • Valid vs. invalid subpoena
  • What to do and what not to do if served with a subpoena
  • How to quash (have the court reject) an otherwise valid subpoena

 

MANDATORY REPORTING LAWS

  • Who has to report?
  • What has to be reported?
  • To whom does it have to be reported?

 

DUTY TO REPORT/DUTY TO PROTECT

  • Do you have a duty to report, a duty to protect, or both?

Bob Stinson, PsyD, JD, LICDC-CS, ABPP, Related seminars and products


BOB STINSON, PsyD, JD, LICDC-CS, ABPP, is a board certified forensic psychologist, licensed to practice psychology since 1999. He is also a lawyer in the state of Ohio. Dr. Stinson is listed in the National Register of Health Service Providers in Psychology, is a Fellow of the American Academy of Forensic Psychology (AAFP), and is a Diplomate in forensic psychology with the American Board of Professional Psychology (ABPP). He has full clinical and special forensic hospital privileges at Twin Valley Behavioral Healthcare in Columbus, Ohio, an inpatient psychiatric hospital operated by the Ohio Department of Mental Health, where he also serves on the hospital's ethics committee. An Adjunct Professor of Clinical Psychology at The Ohio State University, he also supervises clinical psychology students from various university programs.

Dr. Stinson holds membership in the American Psychological Association (APA; and several of its divisions), the Ohio Psychological Association (OPA; where he serves on the Board of Directors and Chairs the Ethics Committee), and he is past-president of the Central Ohio Psychological Association (COPA). He is also a member of the American Bar Association and the Ohio State Bar Association. In addition to working at Twin Valley, Dr. Stinson maintains a private practice, providing consultations and evaluations, specializing in clinical and forensic psychology. He has a special interest in the area of mental health law and ethics.
